Who Can Register a Marriage in Thailand?

Any two adults who are legally free to marry can register their marriage in Thailand, regardless of nationality. Since January 2025, following the Marriage Equality Act, same-sex couples can also legally register their marriage in Thailand under the same process.

Step-by-Step: The Marriage Registration Process

Step 1: Obtain a Certificate of Freedom to Marry (Embassy Affidavit)

Before you can register your marriage in Thailand, you need a declaration from your home country's embassy or consulate in Bangkok confirming that you are legally free to marry. This is sometimes called:

  • Certificate of Freedom to Marry
  • Affidavit of Single Status
  • Declaration of Marital Status

Requirements vary by nationality. Some embassies require you to book an appointment weeks in advance. We recommend contacting your embassy early to understand their specific requirements and processing times.

Common embassies in Bangkok that issue these certificates include the British Embassy, US Embassy, Australian Embassy, German Embassy, and many others.

Step 2: Get Your Documents Certified and Translated

Once you have your embassy affidavit, you need certified Thai translations of:

  • Your passport (biographical page)
  • The embassy affidavit / Certificate of Freedom to Marry
  • Any divorce decree or death certificate (if previously married)
  • Name change certificate (if your name has changed)

Do both parties need to be present?

Yes. Both parties must appear in person at the district office on the day of registration. There is no proxy registration.

What if one partner is Thai?

How long does the whole process take?
